Modifications to software and hardware

Modifications or the replacement of hardware and software components (including firmware) that do not serve the purpose of maintenance or repair are not permitted. The hardware is supplied exclusively for use with the XRNAUT Simulator. As long as the service of the provider is available, any use of the hardware for other purposes requires the written permission of the provider.

Prohibited modifications also include:

  • to physically or digitally remove or make unrecognizable manufacturer names, brands, logos, serial numbers or other indications of origin.
  • Change software labels in the user interface, metadata, log data or accompanying digital files in such a way that third parties can be misled about the origin, integrity, security status or responsibility of the product or software.
  • to remove or obscure mandatory license notices, copyright or CE markings, hazardous substance information, batch, traceability or safety markings.

The following modifications are permitted after written approval:
  • Attachment of additional trademarks of the customerto physical products. The changes must be documented in such a way that the type, time and scope of the change are traceable; this documentation must be submitted to the service provider for approval.

In any form of modification, the customershall be responsible for ensuring that modifications do not violate any statutory labeling, safety or import regulations. The customershall indemnify the service provider against all third-party claims resulting from the unauthorized removal, alteration or concealment of markings or labels, including costs for recall measures, fines, damages and defense costs. He is liable for all direct and indirect damages resulting from violations of this clause. The service provider has the right to check compliance with these conditions. In cases of suspicion, it is the responsibility of the customerto demonstrate that modifications have been carried out in accordance with the rules.

In the event of serious violations, the service provider may withdraw user licenses and block access accounts.

These provisions shall apply for the duration of the contractual relationship and for a period of 6 years after termination of the contractual relationship.
